On July 15, 2026, new regulations came into force establishing a client compensation fund for individuals harmed by the conduct of CICC licensees. This is a material change to the regulatory landscape for RCICs, and it is worth understanding what it does and what it means for your exposure.
What the Fund Does
The compensation fund allows clients who have suffered financial harm as a result of an RCIC’s professional misconduct to apply to the College for compensation. If the College pays out from the fund, it acquires subrogation rights against the licensee responsible. That means the College can pursue RCIC directly to recover what it paid out to their former client.
This is a significant shift. Before July 15, the College’s ability to order direct restitution to clients in discipline proceedings was limited. The gap was visible in decisions like CICC v Mittal, 2026 CICC 23, decided on June 25, 2026, where clients who suffered substantial financial harm received nothing from the proceeding because the jurisdiction to order restitution did not yet exist. That gap is now closed.
What This Means for RCICs in Practice
The compensation fund changes the financial exposure picture for any RCIC facing a complaint. Previously, the financial consequences of a discipline proceeding were largely limited to fines, costs, and whatever restitution a panel had jurisdiction to order. Going forward, a client who suffered harm has a direct avenue for compensation through the College, and the College has a mechanism to recover what it pays out from the RCIC.
The practical implication is straightforward. If your practice has supervision gaps, trust account irregularities, or clients who were harmed by the conduct of unlicensed staff, your exposure is no longer limited to what happens inside the discipline proceeding. It extends to what the College pays out from the fund on your clients’ behalf.
