Motor Vehicle Accidents

Slip and Falls

If you happened to fall and got hurt as a result, you may be entitled to compensation for your injuries and damages. Unfortunately falls often lead to severe trauma, such as fractured legs, arms, shoulders and ankles, along with head injuries. Actions arising out of falls on municipal or federally owned property are conditional upon strict Notice requirements under the Municipal Act, 2001, S.O. 2001, c. 25 and  Crown Liability and Proceedings Act R.S.C., 1985, c. C-50, respectfully.There are also additional Notice considerations that may be applicable to slip and fall cases.

Snowmobile and ATV Accidents

Under the Motorized Snow Vehicles Act, R.S.O. 1990, c. M.44 , snowmobiles that are operated outside owner’s property must to be insured under a motor vehicle liability policy. Similarly, the  Off-Road Vehicles Act, R.S.O. 1990, c. O.4 requires all ATVs to be insured by a motor vehicle liability policy. 


This means that if you got injured in a snowmobile accident or ATV accident, even if you were the one at fault, you are likely eligible to receive medical rehabilitation benefits, attendant care and possibly income replacement or non earner benefits from your auto insurance. If you have purchased an extended auto insurance  policy then you may also qualify for housekeeping benefits. If the accident was caused by a malfunction of your snowmobile or ATV, you may be able to proceed against the manufacturer and distributor with a product liability claim.

​In the event your injuries were caused by someone else who was operating a snowmobile or ATV you may be able to sue that person for the same tort damages as if your injuries were caused by a motor vehicle accident. 

Civil Liability for Assault and Battery

Product Liability Litigation

Product liability litigation refers to instances where a person suffers an injury while using what turns out to be defective product. Some examples here include fall related injuries in case of a faulty wheelchair, permanent foot injuries  as a result of wearing hockey skates with displaced foam padding, injuries and damages sustained due use and operation of various kitchen appliances, and so forth.

Normally it is not possible to know whether the product has been defective before the accident occurs. It is only after the fact when counsel retains an engineering expert, an opinion on liability can be obtained. ​
